(c) Upward revision of rent a sper S.C. Order dated 19.12.1997 and thereafter every year to neutralized erosion in the rupee value.
(d) Abolish Eviction of tenants / lessee must be compulsory for defaulting rent for more than 1 year & the tenant / lessee must loose protection of Rent Act permanently. And court must pass decree for possession of premises to the owners within 2 months. Further the tenants / lessee should be liable to pay market rent with 18% interest till possession of premises.
(e) Maharashtra Rent Control Act 1999, Legislations should be amended to stimulate investment in rental housing in line with a Model Rent Control Act & National Housing Policy 2005 & Directions of SC Order dated 19.12.1997 and after a period of 5 years abolish the Rent Act and the Rental Housing be governed under the Transfer of Property Act.
(f) Market Rent: The new Rents be permitted to be collected for the New premises or first time letting AND the rates for earlier rental premises be 25% of the Market Rents prevailing in the locality.
(g) Increase in net rent Rs.5/= per sqft per month for residential and Rs.10/= per sqft per month for non residential OR 50 times the existing rent (Frozen Rents), whichever is higher.
(h) Limiting inheritance of tenancy to legal heirs who are living for atleast 2 years prior to the death of the original tenant
11. SUGGESTIONS REGARDING MUNICIPAL TAXES.
It is suggested that where-ever there are "frozen rents", the "rateable value" system may continue and where-ever there are "market rents", the rate of Municipal taxes should be between 1 to 5% of the market rent and unit rate per square per month be adopted instead of Capital Value System.
12. SUGGESTIONS REGARDING STAMP DUTY ACT: Stamp duty on conveyance should be further reduced from 5% to 3%. AND for creating Tenancy between the landlord and the new tenant the Stamp duty was charged vide Article 36 of Schedule 1 of Bombay Stamp Act, i.e. 5% of 120 months' Rent and the same should be restored.
If proper policy and incentives are given by the government to the owners of the properties, the houses can be made available at affordable prices and the premises also would be available on rental basis and all the properties containing crawls / old buildings and slums would be re-developed in a period of 10 to 15 years or so and cities would be free from old buildings /chawls and slums.
